Terms of sale
These terms apply when you buy a license on Oroboro.
Who you buy from
Our plugins and their licenses come from Oroboro Limited, Hong Kong ("Oroboro", "we"). Payments are processed by Stripe. For purchases through Stripe's checkout, Stripe's Link is the merchant of record: it takes the payment, charges any sales tax or VAT, and sends your receipt, under its own terms shown at checkout.
What you buy
A license to use a plugin under the license agreement below. The product page says what the plugin does and on how many computers a license may be used. The download is also the free demo: please try it before you buy. Prices are shown on the product page and in your cart; taxes are added at checkout where they apply.
Delivery
Your license is in your account as soon as the payment is confirmed, and we email it to you.
Right of withdrawal
If you're a consumer in the EU or the UK, you normally have 14 days to withdraw from a purchase of digital content. Because we deliver licenses immediately, we ask you at checkout to agree to that and to confirm that you then lose this right; the license email confirms it.
Refunds
If something is wrong with what you bought, your statutory rights are unaffected: write to us and we'll make it right, or refund you where the law requires. Beyond that, refunds are at our discretion. A refunded license ends, and you must stop using it.
Your account
Keep your password to yourself; you're responsible for what's done with your account. You can delete your account at any time, on your account page.
Liability
Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer. Otherwise our liability for a purchase is limited to the amount you paid for it.
Law
These terms are governed by the laws of the Hong Kong Special Administrative Region. If you're a consumer, you keep the protection of the mandatory laws of the country you live in, and may bring a claim in its courts. We may update these terms; the version in force when you buy applies to that purchase.
License agreement
For Oroboro Modular, Oroboro Bass and our other plugins. By installing or using a plugin, you agree to this license.
The license
When you buy a license, we grant you a personal, non-exclusive license to use the plugin (as a CLAP or VST3 plugin, or as the standalone app) for as long as you like, on up to the number of computers its product page states. You can free a computer on your account page and use the license on another one. Without a license, the plugin runs in demo mode.
What you make is yours
The music, sounds, recordings and patches you make with the plugin are yours, for any purpose, commercial included. Patches and modules you download from the Community Library come under the license their makers chose.
What you may not do
- Share your license file, or let others use your license.
- Sell, rent, lend or distribute copies of the plugin, except as the law allows for a license you bought (write to us if you want to transfer one).
- Modify, decompile or reverse engineer the plugin, except as far as the law allows despite this restriction.
- Remove notices of ownership or of third-party licenses.
License checks
Licenses work offline. When the plugin is online, it checks its license with Oroboro about once a day, sending a hash of the computer's id and the computer's name, so that we can count the computers a license is used on. If a license is used on more computers than it allows, editing is locked until one is freed. See the privacy policy.
Third-party software and modules
The plugins contain third-party software under its own licenses, listed in
THIRD_PARTY_NOTICES.txt in each download; nothing here limits your rights under those
licenses. Oroboro Modular can load modules made by other developers. Those from the Community
Library are signed so you know who made them, but signing isn't a review or an endorsement; modules
you load in developer mode are your responsibility.
Warranty and liability
We want the plugins to work well, and we fix the problems we learn about. But they're provided "as is", without warranties beyond those the law requires; your statutory rights as a consumer are unaffected. As far as the law allows, we're not liable for indirect or consequential loss, or for lost data, sessions or profits, and our total liability is limited to what you paid for the license.
Ending the license
The license ends if you break this agreement, or if your purchase is refunded; you must then stop using the plugin. This agreement is governed by the laws of the Hong Kong Special Administrative Region; if you're a consumer, you keep the protection of the mandatory laws of the country you live in.
Privacy policy
Oroboro Limited is responsible for the personal data described here. Questions and requests: contact@oroboro.space.
What we collect, why, and for how long
- Your account: your email address, a hash of your password, whether you've confirmed the address, and whether you want newsletters. To sign you in, deliver your licenses and support you. Kept until you delete your account (on your account page): then it's erased, with what you published in the Community Library, your comments and your reviews. Orders stay for their seven years, without your email.
- Signing up: the network address an account is made from, counted for an hour in memory and never stored, to limit how many accounts one address can make. To keep automated sign-ups out.
- Orders and licenses: what you bought, when, and for how much, with your email address in each license file. To deliver and prove your licenses, and for our accounts. Orders are kept for 7 years, as Hong Kong law requires; licenses for as long as they're valid.
- The computers a license is used on: a hash of each computer's id (not the id itself), the computer's name, and when it was first and last online. To apply the license's computer limit, and so you can free a computer. Kept until you free it or the license ends.
- Signed-in plugins: a hash of each plugin's sign-in token, the device's name and when it was last used. Kept until you sign out.
- Visits: which pages a visitor reads in a day, in order and when, the site they came from, what their browser says about itself (its name and version, the operating system and kind of device, its languages, and Do Not Track or Global Privacy Control if set), and the rough location of their address. A visit is linked by a daily hash of the address and browser: the address itself isn't kept, and a visit can't be linked to another day's. Kept for 400 days, to see how the site is used.
- Newsletters, only if you opted in: when you open one and which links you click, with the address it came from, its rough location and your browser's name. Kept for one year. You can unsubscribe at any time, with the link in each newsletter or on your account page.
- The Community Library: your artist name, what you publish, your downloads and ratings, reports you send, and moderation decisions about what you publish. Kept as long as the item or your account exists.
- Emails you send us: to answer you; kept for up to two years.
We don't use advertising or tracking cookies. The only cookie keeps you signed in.
What the plugins send
The plugins work offline. When it's online, Oroboro Modular checks its license about once a day (as described above), checks for updates about once a day, sending its version and platform and your sign-in if you're signed in (you can turn this off in its About panel), and talks to Oroboro when you sign in or use the Community Library.
Our other plugins check for updates: when a plugin's window opens, at most once a day per plugin, it asks Oroboro whether a newer version of that plugin is out. The request carries only the plugin's name, version and operating system, plus your IP address as any web request does, and no license, account or other personal details. You can turn this off in the plugin's Settings. They don't check their license online.
The iPad and iPhone apps
The apps from the App Store collect nothing and track no one: no analytics, no advertising, no accounts of their own. Your presets, patches and settings stay on your device (and in your device's backups). The apps don't check licenses: buying one in the App Store is the license.
Oroboro Modular's app can sign in to Oroboro if you choose to, to publish patches to the Community Library. Signed in, it sends what's described above for signed-in plugins and the library, and nothing more.
Apple handles your purchase, and, if you agree to share them with app developers, crash reports and usage figures, under Apple's own privacy policy. We see those only as Apple reports them, and never with your name.
Who else handles your data
Stripe processes payments, and its Link is the merchant of record, under its own privacy policy. Resend sends our emails. Our hosting provider runs our servers. Places for addresses come from DB-IP's database, kept on our own server, so no address is sent anywhere for that. Some of these are outside your country; where the law requires, we use standard contractual clauses or another lawful way to transfer data.
Your rights
You can ask for a copy of your data, and ask us to correct it, delete it, restrict or object to its use, or hand it to you in a portable form, by writing to contact@oroboro.space. You can also complain to a data protection authority: in Hong Kong the Privacy Commissioner for Personal Data, in the UK the ICO, in the EU the authority of your country. We'll post changes to this policy here, and email you about important ones.
